Enforcement action taken against major UK stove manufacturer

A major UK stove manufacturer has recently faced enforcement action by the Office of Product Safety and Standards (OPSS). Compliance notices have been issued in relation to Ecodesign and Energy Labelling after the manufacturer was found to have not made all relevant technical information and documentation available. 

The OPSS found CVS ENERGY LIMITED t/a Clearview Stoves to be in breach of the following regulations across ten of their products: 

  • Regulation 14(1) of Ecodesign for Energy-Related Products Regulations 2010.   
  • Regulation 11(1)(b) of the Energy Information Regulations 2011. 

 

Compliance notices were served to the UK manufacturer after the OPSS deemed, beyond reasonable doubt, that the business had committed an offence under Regulation 14(1) of Ecodesign for Energy-Related Products Regulations 2010 and the manufacturer’s energy-related products did not comply with an applicable implementing measure. 

When a business has been served a compliance notice by the OPSS, they are required to act within a specified time period to ensure non-compliance does not continue or recur. Effectively, the compliance notice is a written warning to a business, requiring them to either demonstrate compliance or to gain compliance before a deadline.
